Asset Protection Planning in Elder Law

Saving assets of an individual in a nursing home has become more difficult as a result of government efforts to prevent Medicaid planning. Whether you are single or married, on the verge of becoming a nursing home resident, or planning ahead to try to save your assets for your family members if a home stay seems likely, our Estate Planning and Administration Group can help you understand how the recent changes in the laws affect you and your family.


Although Medicaid planning has become more difficult, there are still options available; for example, certain transfers of assets among family members will not cause ineligibility for Medicaid; special qualifying annuities can be purchased to help protect assets; the spouse of a nursing home resident living in the community is afforded some additional financial protection; and benefits may be available for veterans or their widows/widowers.
